“Oakland police Officer Kevin Kelly, 24, had been talking to another patron having breakfast at a restaurant there and told her he was a police officer, but she didn’t believe him, Esparza said. To prove it, Kelly, who had been drinking, allegedly pulled out a handgun, pointed it at the woman and at the restaurant’s ceiling, Esparza said. The woman told the restaurant’s staff that Kelly had a gun and the police were called. Kelly was arrested and cited for misdemeanor brandishing a firearm, Esparza said. His weapon, which was not department-issued, was booked into evidence, according to Esparza.”
