The judge replied by pointing out that the condom used had been manufactured in another state, and therefore the federal government was within its right to prosecute based on the legislation emanating from the Interstate Commerce Clause in the Constitution. When the government awards to itself unassailable legal cover for its every action, then by definition no rule is permanent, no law nonmalleable, and no corner of human action impervious to government assault.”
