Judge Napolitano: A Conspiracy of Silence Assaults Privacy

“Why were all members of Congress but the 22 on this committee kept in the dark about NSA and FBI lawlessness? Why didn’t the committee reveal to Congress what it claims is too shocking to discuss publicly before Congress voted on surveillance expansion? Where is the outrage that this information was known to a few in the House and kept from the remainder of Congress while it ignorantly voted to assault the right to privacy? The new law places too much power in the hands of folks who even the drafters of it have now acknowledged are inherently unworthy of this trust.”

Release The FISA Memo. Let’s See What’s In It

“The allegation that the Obama administration put the law-enforcement and intelligence arms of the federal government in the service of the Clinton campaign to undermine the Trump campaign is, they maintain, an overwrought conspiracy theory. If that is true, then Democrats — who have had the opportunity to review the memo — should be clamoring for it to be disclosed, not fighting its release.”

U.S. Border Crossings Have Become Authoritarian Testing Grounds

“The border is seen by the government as a civil rights-free zone where U.S. citizens are being increasingly treated like criminals and subject to the exact same sort of degrading abuse as my brother’s girlfriend. This is something I’ve been meaning to write about for a while, and this recent experience inspired me to do so today. Many of you have no idea how bad things already are.”

U.S. v. Microsoft: It’s the right to privacy, stupid

“The issue presented in Microsoft is whether the antiquated Electronic Privacy Communications Act (EPCA) authorizes search warrants to compel Internet service providers to retrieve and surrender a customer’s electronic documents that are stored on computer servers located outside the United States where compliance would violate foreign law.  The correct answer is ‘NO.'”

New Jersey Requires a Permit To Preach In Public

“The preachers sued, arguing they were deprived of their right to free expression. They also claimed they were discriminated against on the basis of religion. But true to form, the New Jersey government closed ranks and doubled down on their position. As a state agency, New Jersey Transit argued that they have immunity from civil claims of rights violations.  And the worst part is, a U.S. circuit court of appeals agreed with the state of New Jersey. They said state permitting laws trump basic rights like free speech.”

Sessions Says to Courts: Go Ahead, Jail People Because They’re Poor

“Last week, Attorney General Jeff Sessions retracted an Obama-era guidance to state courts that was meant to end debtors’ prisons, where people who are too poor to pay fines are sent. These burdens fell disproportionately on African-Americans. The push to abolish debtors’ prisons will continue, as community advocates and local officials press on. It would be preferable, of course, for the federal government to fulfill its role as a leading protector of basic constitutional rights. Unfortunately, Mr. Sessions has made clear that under his leadership it will not.”

Black helicopters and ‘Ride of the Valkyries’: The war on pot in California

“Still fighting the culture wars, Reagan and his advisers decided early on that marijuana was the biggest drug threat facing the country. And so a couple of years into his first term, federal and California officials came up with a battle plan to target cultivation in the northern part of the state. The phrase ‘battle plan’ isn’t much of an exaggeration here.”

72yo Grandma Shot Dead as SWAT Raided Her Home For Marijuana

“A Bartlesville SWAT team executed a search warrant to bust Livingston for the alleged sale of marijuana.  When the heavily armed and likely militarized men kicked in the door to their home, Townsend, likely not knowing who her home invaders were, picked up a pellet gun and fired off two pellets. A Bartlesville officer then shot and killed her.”

John Whitehead: Round Ups, Checkpoints and National ID Cards

“The problem with allowing government agents to demand identification from anyone they suspect might be an illegal immigrant—the current scheme being employed by the Trump administration to ferret out and cleanse the country of illegal immigrants—is that it lays the groundwork for a society in which you are required to identify yourself to any government worker who demands it.”
