California D.A.: Mom Facing Jail Time Over Homemade Ceviche Is Overreacting

“A California DA says the single mother of six facing prosecution for selling 32 ounces of homemade ceviche is ‘making more of this than it is.’ Mariza Ruelas, 37, made headlines Monday when she claimed to be facing a year in jail for a Facebook-based hobby. Ruelas and five others were busted when San Joaquin County investigators posed as members of the suspects’ Facebook group, where they traded recipes and sometimes sold dishes to each other. One undercover investigator asked to buy some of Ruelas’ homemade ceviche, and she was promptly charged with operating a food facility and business without a license.”

Owner of kite-surfing island for Silicon Valley executives faces $4.6 million fine

“A state water agency has proposed one of its largest fines ever — $4.6 million — against a Bay Area man for allegedly damaging an island by transforming it into a luxury sporting enclave for Silicon Valley executives.  After purchasing the island in 2011, Sweeney sought to revive a decades-old duck hunting club at the island. He launched a kite-surfing outfit with marketing materials that tout its seclusion and convenience for Silicon Valley and Bay Area executives. The San Francisco Bay Conservation and Development Commission issued a cease-and-desist order on April 22, concluding that Sweeney and the club violated two state laws.”

California Law Allowing Government to Seize Legal Guns Goes into Effect

Beginning January 1, gun regulations in California will give authorities the right to seize a person’s weapons for 21 days if a judge determines the potential for violence exists.  The ‘law gives us a vehicle to cause the person to surrender their weapons, to have a time out, if you will, Los Angeles Police Department Assistant Chief Michael Moore told a local NPR affiliate.  You read that right — a government-imposed time out. Now go sit in the corner, and think about what you did.  Second Amendment and constitutional advocates have been understandably upset by the coming law, saying further rules in a state already rife with restrictive gun laws will only serve to punish law-abiding gun owners.”

On Airbnb Rentals, California Cities Tax First and Regulate Later

“Earlier this year, the beachside city of Santa Monica made headlines by enacting a ban on the short-term rental of a full unit.  Still, as Santa Monica begins its enforcement effort in earnest, it’s finding it needs to devote every penny of the hotel tax in that direction.  ‘The money that we are going to collect on the now-legal short-term vacation rentals is only enough to pay for the two code people and staff analyst to do effective enforcement against the illegal ones that were doing us so much damage,’ says Santa Monica Mayor Kevin McKeown. ‘So it’s probably going to be revenue-neutral for the city.'”

Family Gets $4.9M After Calif. Cops Beat Homeless Son to Death on Video

“Because the assailants who beat Kelly Thomas to death on the streets of Fullerton, California were swaddled in government-issued costumes and clothed in ‘qualified immunity,’ the killers went free, and the city’s taxpayers will have to underwrite a $4.9 million civil settlement with the victim’s family, reports the Orange County Register. Video recordings of the assault captured the anguished screams of the helpless, unarmed, 160-pound man as he was slugged, kicked, tasered, and clubbed as the attackers bellowed, ‘Stop resisting!’ With his last words Kelly pleaded for his father Ron Thomas, a retired sheriff’s deputy.”

California collects, owns and sells infants’ DNA samples

“If you were born in California since 1983, the state owns your DNA.  The data of every Californian born since that year is kept in a bland office building in Richmond, a city located in the eastern section of the San Francisco Bay Area.  That data’s not just passively kept, mind you: it’s also being sold, to third parties, for research purposes.  That biometric data, taken by a heel prick at birth to screen for 80 hereditary diseases, represents a wealth of information on an individual, from eye and hair color to pre-disposition to diseases such as Alzheimer’s and cancer. Besides being sold – in purportedly de-identified form, it’s also available for law enforcement requests.”

California pushes 350-foot no-fly drone law; government exempt

“The drone wars are heating up in California as legislators move to ban unmanned aerial vehicles (UAVs) from flying within 350 feet above property ground level without the operators having received express permission.  Senate Bill 142 contains an exemption for lawful flights of government and law enforcement drones.  In other words, you can consider it a proposed ban on private and commercial UAV use – a dismal prospect for companies such as Amazon, with its plans to fill the sky with delivery drones; Google, with its own drone delivery service; and GoPro, the body-wearable camera maker that recently announced it was making its own drone.

After leaf blower scare, security checks now on the bill for movie theaters

“As many as three men sparked a stampede at the theater by brandishing a leaf blower that some mistook for a chainsaw.  In response, some movie chains in Orange County are beefing up security. Bags are being searched, pre-movie safety messages are aired and, in at least one theater in Southern California, metal detectors are deployed.  Security is an issue for at least some movie fans. A recent survey of moviegoers by the research firm C4 for Variety found about one-third wanted theater lobbies to have both an armed guard and metal detectors. Nearly a third also wanted bags searched.  Law enforcement in Orange County said Monday they are keeping an eye on movie theaters.”

Xapo Moves to Switzerland Citing Customer Privacy Concerns

“The bitcoin services and security firm said the transition was put in motion three months ago at the request of customers, and that now, Xapo‘s operations in Palo Alto are in the process of being reduced. As part of the transition, Xapo will hire new finance and legal staff in the central European nation while still keeping a small US presence.  Xapo moved its deep cold storage vault servers to an unspecified location in the European nation in January, but continued to face pressure from customers for more privacy guarantees, Casares said.  ‘We decided to do what they had been asking us to do for a while, move our main company to Switzerland and benefit from the safeguards,’ Casares explained.”

Berkeley’s new soda tax panel begins allocating seized funds

A new Berkeley ‘panel of experts’ charged with allocating money collected from the city’s recently implemented soda tax convened for the first time Tuesday night, electing Jennifer Brown and Xavier Morales as chair and vice chair, respectively.  Brown, a parent and soda tax activist, and Morales, executive director of the Latino Coalition for a Healthy California, will lead the nine-person panel, officially titled the ‘Sugar-Sweetened Beverage Product Panel of Experts,’ in bi-monthly or monthly meetings that will establish the direction of funding from Berkeley’s new sugar-sweetened beverage tax, which was approved by voters in November.  The soda tax had brought in $116,000 in its first month.”
