‘Respect State Marijuana Laws Act’ Introduced In Congress

“United States Congressman Dana Rohrabacher (R-CA), along with a bipartisan coalition of three Republicans (Reps. Rohrabacher, Rep. Justin Amash [R-MI], and Don Young [R-AK]) and three Democrats (Reps. Earl Blumenauer [D-OR], Steve Cohen [D-TN] and Jared Polis [D-CO]) today introduced House Bill 1523: the Respect State Marijuana Laws Act.  The measure would amend the federal Controlled Substances Act to exempt from federal prosecution individuals and businesses, including marijuana dispensaries and/or retail outlets, who comply with state marijuana laws.”

Massachusetts Supreme Court Clears Drivers In Marijuana Search

“In a series of three rulings issued Friday, the Massachusetts Supreme Judicial Court cracked down on police who have been using evidence of marijuana possession as a pretext to search automobiles. In 2008, 62 percent of state voters approved an initiative that decriminalized possession of up to one ounce of marijuana. To justify the search, prosecutors argued that by passing around a joint, Pacheco was guilty of ‘distribution’ of marijuana, which is punishable by two years in jail. The state argued the trooper’s search was valid because he was investigating the crime of distribution. The high court did not agree.”

Massachusetts Attorney General: Pot shops allowed statewide

“Massachusetts Attorney General Martha Coakley ruled Wednesday that medical marijuana dispensaries must be allowed statewide and individual municipalities cannot legally block them.  The ruling (PDF) was issued by Coakley’s Municipal Law Unit in response to a 2012 bylaw passed by officials in Wakefield, Massachusetts. Two other nearby towns also passed a similar ordinance.  It says that the legalization of medical marijuana, enshrined in state law, ‘cannot be served if a municipality were to prohibit treatment centers within its borders, for if one municipality were allowed to do so, all could do so, making reasonable access impossible.'”

Washington cops working to ‘desensitize’ drug dogs to marijuana smell

“Police in Washington state are working to retrain their drug-sniffing dogs so that they’re less likely to alert when they smell marijuana.  The retraining is part of the state’s law enforcement reforms following November’s voter-backed legalization measure, which will ultimately require police to notify judges as to whether a drug dog used to obtain probable cause for a search has been trained to comply with state law.  While most departments are going along with the change, including the Washington State Patrol, the Tacoma Police Department is refusing to comply.”
