“Nullification acts have been introduced in state legislatures all across the country, particularly in the last few months.  According to one estimate at the Tenth Amendment Center, which tracks such things, there are more than 70 proposed bills to nullify federal laws and practices now in state legislatures, sometimes consciously labeled nullification, sometimes not. For example, 12 states have introduced proposals for state marijuana laws in defiance of federal regulations under the Controlled Substances Act of 1970. State laws against National Defense Authorization Act indefinite detention provisions have been introduced in almost half the states.”

Jury Nullification Advocate Out Of Jail, Files Federal Lawsuit Against Judge

“Mark Schmidter is a free man after spending 104 days in the Orange County Jail.  He was convicted late last year of indirect criminal contempt by Chief Judge Belvin Perry for handing out flyers at the Orange County Courthouse in the months leading up to and during the Casey Anthony trial. He says his fight over free speech is not over. Those flyers explained the right of jurors to nullify convictions if they thought the law was wrong, even if a defendant had committed the crime. Schmidter says he will jump right back into the fray now that he has served his time.”

Colorado Sheriffs Unite to Block ‘Unenforceable’ Gun Control Laws

“In the wake of the tragedy in Aurora, Colorado passed some of the strictest gun control measures in the country. But in recent months, an overwhelming 55 of the state’s 62 county sheriffs have joined a lawsuit aiming to block the measures. Sheriff Terry Maketa of El Paso County is one of the opposing sheriffs. Maketa says they believe the laws are unenforceable, but also violate the Second and Fourteenth Amendments. After explaining the tactics used to pass the bills that essentially ‘eliminated all public input,’ Maketa reiterated that it’s clearly an ‘overreaching step’ for politicians to claim law enforcement supports stricter gun control.”

Florida Sheriff Arrested After Defending Second Amendment

“A Florida sheriff who believes in the Second Amendment was charged Tuesday for removing the arrest file of a suspect held on an unconstitutional gun charge but later released. Liberty County Sheriff Nicholas Finch, 50, was booked in his own jail Tuesday with one count of official misconduct by the Florida Department of Law Enforcement. The FDLE accuses Finch of covering up the arrest of Floyd Eugene Parrish after releasing him from the Liberty County Jail. Parrish had been arrested for carrying a concealed firearm without a license, a third-degree felony in Florida.”

Marijuana’s IRS Problems Spark New Bill

“Rep. Earl Blumenauer (D-OR) will introduce the Small Business Tax Equity Act of 2013 on June 5, with the goal of ending the Internal Revenue Service’s persecution of medical cannabis dispensaries.  The Small Business Tax Equity Act of 2013 will amend IRS Section 280E of the tax code to resolve a crisis in the newly legal billion-dollar industry, according to Betty Aldworth with the Washington D.C. lobby National Cannabis Industry Association. Marijuana is a federally illegal drug that 20 states have legalized for medical purposes. Two have legalized its use for adults over 21. But the IRS treats all marijuana-related businesses as ‘drug trafficking organizations’.”

Facing 81 Years For Marijuana, Rich Paul Planning To Appeal Convictions

Colorado Gun Control Law Is Unenforceable, Say 54 Of 62 Colorado Sheriffs

“A gun control law set to go into effect in July specifies that anytime that a gun owner allows anyone to have control of his gun for over 72 hours, that person to receive the gun must go through a background check. Of Colorado’s 62 sheriffs, 54 are publicly protesting the law. It is unenforceable, they say. The law has other unenforceable features, such as banning rifle magazines that could possibly be expanded to hold more than 15 rounds. Anyone who owns such a magazine cannot sell it or lend it. The sheriffs are part of a lawsuit in federal court. The lawsuit says the law is unconstitutional. The state committee that heard testimony allowed only one sheriff to testify.”

Erie County Sheriff Howard on SAFE Act: ‘I won’t enforce it’

“It’s no secret Sheriff Timothy B. Howard is opposed to New York’s new gun-control law. But Howard, who is running for re-election this year, is now ratcheting up his opposition by filing a friend of the court brief in the lawsuit seeking to overturn the SAFE Act and, even more important perhaps, by suggesting the law not be enforced. ‘I’m more than reluctant,’ he said of the new law Thursday. ‘I won’t enforce it.’ Howard, one of four sheriffs who joined in filing the brief this week, said he considers the law unconstitutional and a waste of valuable resources, and believes it will ultimately be overturned by the courts.”

First major hemp crop in 60 years is planted in southeast Colorado

“Springfield, Colo., farmer Ryan Loflin on Monday planted the nation’s first industrial hemp crop in almost 60 years. Loflin’s plans to grow hemp already have been chronicled, and Monday’s planting attracted the attention of more media in southeastern Colorado and a documentary film crew. Its cultivation in small test plots became legal last year under a Colorado law. The passage of Amendment 64 in November allowed commercial growing, even though hemp, like marijuana, is illegal under federal law.”
