World’s largest pot shop can stay open in Oakland, judge rules

“A medical marijuana dispensary billed as the world’s largest cannabis store may stay open while the city of Oakland fights a U.S. government effort to shut it down or seize the property, a federal judge ruled on Wednesday. There has been a tug-of-war in California between federal and local authorities over cannabis sold for purported health reasons. In February, Magistrate Maria-Elena James, the same judge who ruled on Wednesday, said the city had no right to intervene in a federal prosecutor’s civil-forfeiture action against the Harborside Health Center, which was featured on the Discovery Channel reality TV show ‘Weed Wars.'”

Treasury Delays Obamacare Implementation For Businesses Until 2015

EPJ13

“The Obama administration left it to a relatively low level Treasury official to announce the blockbuster news that the Obama administration will not begin enforcing employer mandates in the Obamacare law until 2015 – one year later than originally planned.  Mark Mazur, the Assistant Treasury Secretary for Tax Policy, announced on the agency’s blog that the administration ‘will provide an additional year before the … mandatory employer and insurer reporting requirements begin.’   At this point the individual mandate remains, meaning individuals must obtain health insurance or face penalties.”

Marijuana’s March Towards Mainstream Confounds Feds

“It took 50 years for American attitudes about marijuana to zigzag from the paranoia of ‘Reefer Madness’ to the excesses of Woodstock back to the hard line of ‘Just Say No.’ The next 25 years took the nation from Bill Clinton, who famously ‘didn’t inhale,’ to Barack Obama, who most emphatically did. Now, in just a few short years, public opinion has moved so dramatically toward general acceptance that even those who champion legalization are surprised at how quickly attitudes are changing and states are moving to approve the drug – for medical use and just for fun.”

Colorado Gun Owners Display Blatant Defiance Of New Law

“Stores across Colorado are pulling high-capacity magazines off their shelves. A new law that took effect Monday limits magazines to 15 rounds and some people are already deliberately breaking the law. The law requires background checks on all gun sales, including private ones. ‘We want to, today, to test how this law functions; demonstrate that it is not enforceable,’ a demonstrator told the crowd.  The new laws prompted about two dozen opponents of increased gun control to gather at the state Capitol on Monday at midday in protest. Many swapped and sold high-capacity magazines in plain view of police officers, daring them to make an arrest.”

Activist found not guilty of vandalism for writing with chalk outside Bank of America

“An anti-bank activist who faced more than a decade behind bars for using chalk to voice his protests against Bank of America was found not guilty of vandalism on Monday. A jury found Jeff Olson, 40, not guilty on all charges, according to NBC San Diego.  Olson was charged with 13 counts of vandalism by San Diego City Attorney Jan Goldsmith for writing statements such as ‘No thanks, big banks’ and ‘Shame on Bank of America’ in front of Bank of America branches last year. Mayor Bob Filner had described the prosecution of Olson as a waste of resources and ‘a stupid case.'”

Texas Governor Rick Perry Signs a Pair of Bills Upholding Fourth Amendment

“With Governor Perry’s signature on HB 912, Texas now joins Idaho, Virginia, Florida, Montana, and Tennessee on the list of states that have enacted laws regulating the use of drones in their sovereign skies.  Meanwhile, on June 14, Governor Perry signed into another important bill.  As explained prior to Governor Perry’s signing of the bill by the blog Law360HB 2268 ‘would establish the strongest email privacy protections in the U.S. by becoming the first measure to override a provision in the federal Electronic Communications Privacy Act that allows law enforcement to access emails that are open or more than 180 days old using only a subpoena.'”

National Lawyers Guild Report Supports Further Marijuana Legalization Initiatives

“As the nation waits for a response from the White House, the NLG joins other organizations and individuals in calling for the end to marijuana prohibition. ‘Marijuana legalization will create new jobs, generate millions of dollars in tax revenue, and allow law enforcement to focus on serious crimes,’ said Brian Vicente, NLG member and one of the primary authors of Colorado’s legalization amendment. ‘It would be a travesty if the Obama administration used its power to impose marijuana prohibition upon a state whose people have declared, through the democratic process, that they want it to end.'”

Secession and Nullification in Colorado

thelrcblog-5002

“In response to a few years of anti-rural, anti-gun, and high tax government in Denver, some rural counties in northern and eastern Colorado have proposed that they secede from Colorado. At the center of the effort is the Weld County government, which is controlled by rural and agricultural interests, and relatively more bible-belt-ish compared to much of the state.  In addition, the northeastern part of the state is experiencing an oil-driven boom thanks to oil discovered in the Niobrara formation. These newly oil-rich counties also want to opt out of regulations they anticipate will be coming from Denver.”

Colorado Governor Signs Marijuana Legalization Bills

“In a public ceremony at the state capitol in Denver Tuesday, Colorado Gov. John Hickenlooper (D) signed into law four bills that will establish a legal, regulated marijuana market for adults and begin the development of a regulatory framework for industrial hemp production.  The package of bills had passed the legislature earlier this month in accord with the requirements of Amendment 64, which won with 55% of the popular vote last November. That groundbreaking vote led Hickenlooper to sign an order legalizing marijuana possession and to appoint an Amendment 64 Implementation Task Force late last year, which provided guidance to the legislature.”

Carroll County passes resolution opposing new Maryland gun law

“Carroll County officials have taken a stand against Maryland’s tough new gun law, voting to support law enforcement officials who use discretion in choosing when to enforce it. The Board of County Commissioners unanimously passed a Second Amendment Preservation Resolution, stating that it believes Maryland’s new law is unconstitutional. Two other counties — Cecil and Harford — also have passed resolutions opposing the law.”
