How should states fight the NSA? Turn off the water, say some

“Two California state senators have introduced a bill that would stop state agencies from assisting the National Security Agency to collect ‘any electronic data or metadata… not based on a warrant.’  In addition to stopping state agencies and officials from helping with warrantless surveillance, it would ban corporations that do business with the state from offering such assistance. That could leave the large telecom companies in a legally difficult position: following orders from the federal Foreign Intelligence Surveillance Court would put them them in violation of state law.  Another proposal pushed by the Tenth Amendment Center is the idea of barring the NSA from recruiting at public universities.”

Some NSA Opponents Want to ‘Nullify’ Surveillance With State Law

“The activists would like to turn off the water to the NSA’s $1.5 billion Utah Data Center in Bluffdale, Utah, and at other facilities around the country.  Dusting off the concept of ‘nullification,’ the coalition plans to push state laws to prohibit local authorities from cooperating with the NSA.  Draft state-level legislation called the Fourth Amendment Protection Act would – in theory – forbid local governments from providing services to federal agencies that collect electronic data from Americans without a personalized warrant.  The city of Bluffdale is reportedly charging the NSA a rate of $2.05 for every 1,000 gallons of water, significantly less than the typical rate.”

“Secessionist movements are all the rage these days. A handful of counties in Colorado tried to secede from the rest of the state earlier this year.  There’s an attempt to create the State of Jefferson (northern California/southern Oregon) via ballot initiative in 2014.  And there’s plenty more.  What would the U.S. look like if all of the secession movements in U.S. history had succeeded?  Well, Mansfield University geography professor Andrew Shears built a map to answer that question. (It covers secession movements through the end of 2011.)  His 124 states of America is below.”

2013: The Year Defiance of the State Became Cool

And surveillance whistleblower Edward Snowden went into exile in Russia to escape what promised to be a ‘fair’ trial followed by a first-class hanging. But tough consequences aren’t unusual for people who defy the state. What was different and encouraging was how many people rallied behind Swartz, Manning, Snowden, and other rebels, explicitly siding with them over the government, in opposition to the powers-that-be.”

Utah Gets Ready To Do Without the Feds

“Like most westerners, Utahns are pissed about federal control of land and purse strings. Unlike most, though, they seem serious about reshaping that relationship.  In 2012, Utah passed the Transfer of Public Lands Act, essentially demanding that the federal government surrender the two-thirds of the state controlled by Washington, D.C. Other western states are considering similar measures, but Utah paved the way.  But Utah is preparing to go a step further and plans for a future that isn’t funded by federal largesse. The state passed a series of bills as part of a Financial Ready Utah movement.  Utahns foresee a day when whatever they want done will have to be paid by local funds.”
