“Forty-two state attorneys general, however, have given the U.S. Food and Drug Administration a sharp nudge to regulate the advertising, ingredients and sale to minors of the devices.  FDA Deputy Commissioner Sally Howard wrote the AGs that the ‘FDA intends to extend its authority over products that meet the statutory definition of ‘tobacco product.’’ The proposed rule to accomplish this is under review by the Office of Management and Budget, she said.  ‘I can’t stress enough this is about protecting youth. A uniform policy by the FDA makes the most sense. That’s why our preference was to move forward in this direction,’ Jackley said of the AGs letter to the FDA.”

ObamaCare slams smokers with sky-high premium costs that could backfire

“ObamaCare may have backfired in its goal of making smoking so expensive that users quit, public health experts say, as sky-high insurance premiums force smokers to drop coverage altogether and lose smoking cessation programs along with it.  Unlike drug addicts, alcoholics, or the obese — all of whom represent higher-than-average medical costs — smokers are the only such group with a pre-existing condition that ObamaCare penalizes. It allows insurance companies to charge smokers up to 50 percent more than non-smokers for an identical policy.  Eleven states stepped in to prevent the surcharge, but a majority have not. In those, insurance providers will decide the surcharge.”

Small business Obamacare online enrollment delayed a year

“The Obama administration today announced a one year delay of online enrollment for small businesses looking to purchase health coverage through federal Obamacare exchanges, another high-profile setback for HealthCare.gov.  It’s the second delay for online small business enrollment, which the administration had said would begin this month.  The announcement just before Thanksgiving is the latest in a series of delays and miscalculations for the president’s signature domestic legislation. On July 2 — also just before a holiday —it delayed the employer mandate for a year. Small businesses with fewer than 50 workers are exempt from the requirement to cover them.”

‘Make 401(k) Auto-Enrollment Mandatory’

FDA Tells Google-Backed 23andMe to Halt DNA Test Service

“23andMe Inc., the Google Inc.-backed DNA analysis company co-founded by Anne Wojcicki, was told by U.S. regulators to halt sales of its main product because it’s being sold without ‘marketing clearance or approval.’  The Saliva Collection Kit and Personal Genome Service, or PGS, tells users whether they carry a disease, are at risk of a disease and would respond to a drug. Most of the uses fall into the category of a medical device and require Food and Drug Administration approval, the agency told the Mountain View, California-based company in a Nov. 22 letter made public today.”

Obama visits family of slain TSA officer

“President Barack Obama visited Monday with the family of TSA officer Gerardo Hernandez, who was killed at Los Angeles International Airport earlier this month.  The President also met with Tony Grigsby and James Speer — two other TSA officers who were wounded in the November 1 shooting incident.  A gunman stormed a terminal at the airport on November 1, killing Hernandez and injuring several others.  Hernandez is the first TSA officer to die in the line of duty.  Officers shot suspect Paul Ciancia multiple times during the assault.  He is in the custody of U.S. marshals, charged with the murder of a federal officer and commission of violence at an international airport.”

South Carolina Police Grab Innocent Cell Users’ Data Through ‘Tower Dump’

“The technique, known as a ‘Tower Dump,’ allows law enforcement to request all call, text and data transmissions from any specific time period from a cell tower’s provider. Search warrants obtained by WLTX News uncovered Richland County Sheriffs use of the technique during several cases including a 2011 vehicle break-in outside a sheriff’s home.  Under South Carolina evidence retention laws, if a suspect is convicted of a crime in which a Tower Dump was used, police can hold onto all information gathered for up to seven years, including the data of all innocent cell users.  According to the Richland County Sheriff’s Department, innocent cell users have nothing to fear.”

Police dept. loses insurance, shuts down after lawsuits against 2 officers

“The Point Marion Police Department in Fayette County closed its doors after settling lawsuits against police officers.  ‘We had to lay off the officers due to the fact that we do not have police liability insurance,’ said Point Marion Borough Manager Arthur Strimel. Strimel said the insurance carrier dropped the department after paying two settlements against the department’s only two police officers, including Kevin Lukart, who has been in trouble before.  Lukart had been fired from the Apollo Police Department after he was charged with exposing himself to a 17-year-old.  He was also fired from the Braddock Police Department after a news camera captured Lukart punching a man in handcuffs.”
