Supreme Court: Cops can’t hold suspects to wait for drug-sniffing dog

“The Supreme Court ruled 6-3 on Tuesday that the Constitution forbids police from holding a suspect without probable cause, even for fewer than 10 extra minutes.  Writing on behalf of the court, Justice Ruth Bader Ginsburg declared that the constitutional protections against unreasonable search and seizure prevent police from extending an otherwise completed traffic stop to allow for a drug-sniffing dog to arrive.  According to the Supreme Court, while officers may use a dog to sniff around a car during the course of a routine traffic stop, they cannot extend the length of the stop in order to carry it out.”

And what are the worst precedents handed down by our highest court?  I’ve been thinking about this a lot recently, and here are my nominees for the worst SCOTUS opinions to date.  The standard I’m using for ‘worst’ is three-fold.  First, the holding of the case is unambiguously still guiding precedent.  Second, the holding of the case is inconsistent with the Constitution.  Third, the case either A) has egregious consequences for individual liberty or B) is clearly ideological- or policy-driven rubbish as a matter of constitutional law (whether or not I happen to like the consequences).”

Black Caucus slams Rand Paul for opposing AG nominee Lynch

“The Congressional Black Caucus (CBC) issued a sharp condemnation of Sen. Rand Paul’s (R-Ky.) opposition to Attorney General nominee Loretta Lynch on Thursday.  Paul said he opposed confirming Lynch because she supports civil forfeitures, a controversial law enforcement tactic, but the chairman of the CBC dismissed those concerns.  Under the laws, police departments and other law enforcement agencies can keep the proceeds of properties they seize during investigations — even when they never charge the owner with a crime.  He also cited Lynch’s support for President Obama’s executive action on immigration and what he called her ‘non-committal’ stance on the legality of drone use.”

Judge rules Portland teen not guilty after phone video contradicts police

“Circuit Judge Diana Stuart ruled that Thai Gurule, a Roosevelt High School sophomore, didn’t resist arrest. He also didn’t strangle and assault police officers, she said.  In a strongly worded decision, which took more than 15 minutes to read aloud, the judge said the officers put Gurule at significant risk of injury in ‘a melee of fists and punches and bodies falling upon him.’  The judge said that although police at first might have intended to be gentle with Gurule as they took him into custody, their actions turned into ‘a senseless and aggressive’ show of excessive force.  The judge had previously ruled that police committed an unlawful stop of Gurule.”

Freddie Gray dies one week after Baltimore arrest for nothing

“Video recorded at the scene shows Gray, with his hands behind his back, screaming as police raise him to his feet. They drag him to a waiting van. The attorney added that Gray’s spinal cord was severely injured.  At this point, police are declining to say much about the case, citing ongoing administrative and criminal investigations.  They have not released the incident report, nor have they released the names of the officers involved.  When asked why officers first encountered Gray, Baltimore Police Dept. Capt. Eric Kowalczyk told CNN that they had been working in an area known for violent crime and drug sales. When the officers approached him, Gray fled, Kowalczyk said.”

It’s time to talk about the role of police in our public schools

“Possession of nicotine or a tobacco product by a minor is, by all accounts, a minor infraction. In Ohio, it carries the penalty of a $100 fine, having to attend a tobacco education program, or both.  Or, as they used to do in my high school, authorities would just take it away from you. Case closed.  But that’s not what happened here. The 16-year-old student was arrested on charges of resisting arrest, disorderly conduct, and given a smoking citation. He was also reportedly given a 10-day suspension, which the school later said it had reversed after video of the incident went viral.”

San Diego cop kills service dog after knocking on wrong door

San Diego police shot Ian Anderson’s pet pit bull, Burberry, after apparently knocking on the wrong door for a domestic disturbance call, Anderson says.

“A San Diego cop gunned down a man’s service dog after knocking on the wrong door, the heartbroken owner said.  Ian Anderson claims he opened the door to two officers early Sunday morning, and his pet pit bull, Burberry, bounded out behind him.  The first officer reached down as if to pet the 6-year-old pooch, but his partner danced away, drew his gun and unloaded, surveillance video revealed. ‘Boom. Shot right in the head, and he was done,’ Anderson told NBC San Diego. ‘He was dead.’  The officers were reportedly investigating a domestic disturbance call about 5:30 a.m. and ended up on Anderson’s doorstep by mistake.  It’s not clear why they targeted his house.”

Special operations armored vehicle pulls over driver who flipped the bird

“Lucas Jewell, 23, recorded his interaction on a cellphone with a team of ASO deputies in special-operations uniforms after the imposing Lenco Bear Cat Armored Personnel Carrier stopped his Ford Taurus at the Alachua County Headquarters Library downtown.   Jewell’s video was posted to Truth Voice and it includes his explanation that he gestured at the ASO vehicle because he does not approve of having a militarized police force.  The APC was on an assignment at Ben Hill Griffin Stadium during the Orange & Blue Debut football game.  UF Police Maj. Brad Barber said the APC and the ASO SWAT Team was called to the game as part of a standing security plan that was drawn up years ago.”

State seizes 11-year-old, arrests his mother for defending medical marijuana

“A spokesman confirmed that officers had searched Banda’s home, though he denied it was a raid. He also said the initial anti-drug program was put on entirely by the school — the police had no involvement. At that event Banda’s son apparently contradicted some of the claims made about marijuana. The school then contacted the child protection agency. Police officers showed up at Banda’s at home and asked her permission to conduct a search. She refused. They then obtained a warrant and searched her home. The spokesman wouldn’t comment except to say that there was ‘evidence’ of drug activity. Banda was then arrested and her son was seized from the home.”
