Man Threatened By SF Cops For Holding ‘John 3:16’ Sign in Front of Ballpark

AGOW_SMALL1

“In filing suit in the U.S. District Court for the Northern District of California on behalf of Gino Emmerich, Rutherford Institute attorneys charge that police officers violated Emmerich’s right to free speech and assembly when they forcefully removed him from Willie Mays Plaza, surrounded him and threatened him with arrest if he did not cease displaying his ‘John 3:16’ sign. Institute attorneys point out that Emmerich was in no way causing a disruption in the plaza, the baseball stadium known as ‘AT&T Park,’ or any other business or agency in the area, nor was he acting in a criminal manner. Moreover, other people in the plaza were displaying signs and communicating messages.”

Court Nixes California’s License Revocations For Tax-Debtors

“A California federal judge ordered the state to reinstate a couple’s professional and driver’s licenses Thursday, saying their due process rights were violated when the licenses were revoked over an approximately $450,000 tax debt.  Judge Dean D. Pregerson granted summary judgment to Enna and Vicken Berjikian, agreeing that neither of them was afforded due process because at the time of the suspension they were not provided the opportunity to challenge the delinquent tax liability or resulting license suspensions.”

Tiny California Towns Have Big Asset Forfeiture Histories

“These forfeitures and the partnerships between municipal police and federal agencies rose as the economy of California slid into a slump. Forfeitures through the federal Equitable Sharing Program have tripled while forfeitures using the state’s process have remained flat (and much lower). The reason is pretty simple: California’s asset forfeiture law allows law enforcement agencies to keep only a maximum of 65 percent of the money they seize. The federal program allows law enforcement agencies to keep 80 percent. Some cities appear to be anticipating forfeiture revenue in advance and using forfeited funds to supplant budgeted spending for law enforcement agencies.”

Accusations Tom Selleck Stole California Water Dropped

“Water from a public hydrant that Tom Selleck has been accused of stealing from in dry California was legally purchased, an official said.  The Calleguas Municipal Water District in Ventura County sued the ‘Magnum, P.I.’ star, alleging that a tanker truck filled up at the hydrant and took it to Selleck’s 60-acre ranch more than a dozen times in the past two years.  The district announced a tentative settlement with Selleck on Thursday.  Construction firms and contractors can obtain special meters that allow them to haul water from hydrants for large projects.  The water district said it spent nearly $22,000 for a private detective to investigate.  District officials declined to provide details.”

Is Your Out-of-State LLC “Doing Business” in California?

“Note that the FTB’s determination of when an out-of-state LLC must file tax returns is in contrast with the California Corporations Code.  Under the California Corporations Code, any entity that ‘actively engages in any transaction in California for the purpose of financial gain or profit’ must register with the Secretary of State.  But an out-of-state corporation is not considered to be transacting business in California merely because it is a member or a manager of a domestic or out-of-state LLC [..].  Moreover, the new California Revised Uniform Limited Liability Company Act of January 1, 2014 provides that an out-of-state LLC ‘may’ register in California and does not impose penalties for failing to do so.”

The worst place in the world to start a business

“As a thanks for conducting commerce in their state – commerce that my clients said they would have been bankrupt without – I was subjected to years of hounding by the California Franchise Tax Board.  Even after I paid their $800 annual extortion fee for running a corporation there.  I’ve long said there is no – repeat no – reason for doing business in California. It is, without a doubt, the worst place in the world to start a business.  They’ll tax you endlessly and mercilessly. They’ll subject you to nonsense regulations. They’ll send some inefficient buffoon to your office to inspect everything you’re doing and harass you. Hiring people there is a disaster.”

Helpful Hackers vs. College Regulators

“In January 2014, California’s Bureau of Private Postsecondary Education (BPPE) sent warning letters to at least a half dozen local coding programs. According to VentureBeat, which first reported on the letters, the coding academies were given two weeks to ‘start coming into compliance’ with BPPE regulations. If they didn’t, they risked $50,000 fines and forced closure.  But the supervision these agencies provide also comes with significant costs. In addition to all the paperwork the academies must complete, there will be financial obligations as well: A $5,000 application fee, plus 0.75 percent of their annual tuition revenues, capped at $25,000.”

LA Unions Demand Exemption from $15 Minimum Wage They Created

“Unions want to give workers and business the option — the freedom! — to prioritize what’s important to them and negotiate their own pay! Isn’t that nice. But only if those workers are paying union dues, and only if those businesses are using union labor.  The minimum wage hike was always meant to make independent workers more expensive and make unions look better by comparison. But it’s a bold move for the unions to simply say, in one breath, ‘Everyone deserves a living wage! It’ll be good for everyone! Except us, thank you. We’ll set our own pay — and also, give a break to any businesses who agree to go back to union labor.'”

California Gov. Shuts Down Luxury Bus for Techies

“Leap, the luxury bus service that rolled out in March, has temporarily suspended its service today after facing a new regulatory challenge. The venture-backed private service had set out to improve San Francisco residents’ daily commute by offering an alternative to public transit. But regulators have stepped in to stop it.  Like many startups that have jumped into heavily regulated industries with the hope of improving a service that already exists, Leap has run headlong into authorities who by now are well-practiced at wrangling with ‘disruptive’ startups.  The company said it has received a cease and desist notice from the California Public Utilities Commission.”

Off-Duty Cop Wrestles, Slams Woman Into Car After Fender-Bender

“After video of a man wrestling a woman and throwing her against a car came to light Tuesday, the San Jose Police Department issued a warrant – for the woman’s arrest.  Of course the man ‘being assaulted’ was none other than an off-duty San Jose Cop in plainclothes. The officer reportedly approached the woman – without identifying himself as a police officer – after a fender bender between their cars.  Rather than write down their license plate number and take it from there, as many of us would do, he proceeded to attack what appears to be a teenage girl.  During the struggle, he yells out that he is a cop, but to the casual observer, he looks to be a sadistic abductor.”
